1. INTRODUCTION
Race Ultra values and respects the privacy of the people we deal with. Race Ultra is committed to protecting your privacy and complying with the Privacy Act 1988 (Cth)(Privacy Act), including the Australian Privacy Principles (APPS) and certain aspects of the Information Privacy Act 2009 (Qld) (IP Act) and other applicable privacy laws and regulations.
This document is Race Ultra’s APP privacy policy for the purpose of Australian Privacy Principle 1 of the Privacy Act.
This Privacy Policy (Policy) aims to provide detailed information on:
1. The kinds of personal information that the Race Ultra collects and holds;
2. How Race Ultra collects and holds personal information;
3. The purpose for which Race Ultra collects, holds, uses and discloses personal information;
4. How an induvial may access personal information about them that is held by Race Ultra and seek the correction of such information;
5. How an induvial may complain about a breach of the individual’s privacy, and how Race Ultra will deal with such complaint.
To the extend any part of this document is inconsistent with the Privacy Act (Including the APPs), the Privacy Act shall prevail to the extend of the inconsistency.
2. WHAT IS PERSONAL INFORMATION?
“Personal information” is defined in the Privacy Act and IP Act as any information or opinion, whether true or not, and whether recorded in a material form or not, about an identified individual or an individual who is reasonably identifiable. In general terms, this includes information or an opinion that personally identifies you either directly (e.g. your name) or indirectly.
3. WHAT PERSONAL INFORMATION DO WE COLLECT?
We only collect personal information that is necessary for us to carry on our business functions. The information we collect depends upon the nature of our dealings with you or what you choose to share with us. If you do not give us any of the personal information which we ask you for, it may affect our ability to meet our obligations to you. Protecting confidential information is fundamental to our relationship with our users and to our business. All information received in connection with Race Ultra is subject to strict duties of confidentiality. We will not disclose that information other than according to our professional obligations, as authorised by the User or as contained in this policy.
3.1. The Personal information we collect about you may include the following:
1. your name;
2. your email address;
3. your log-in details and password;
4. any information you voluntarily share with us when you interact with us via phone, email, social media or other forms of communication;
5. any other information provided voluntarily by you as part of your membership or subscription;
You do not have to provide us with your personal information. Where possible, we will give you the option to interact with us anonymously or by using a pseudonym. However, if you choose to deal with us in this way or choose not to provide us with your personal information, we may not be able to provide you with our services or otherwise interact with you. We do not collect or store your financial details as these are processed by a third party.
3.2. Children Under the Age of 16
We are committed to protecting the privacy of children. The use of Race Ultra is not directed at children aged under 16. Race Ultra will not intentionally collect information about any user under the age of 16. If a child under the age of 16 wishes to use Race Ultra consent must be given by a parent or legal guardian, and this must be under the supervision of a parent or legal guardian.
If you become aware that information from a child under the age of 16 has been disclosed to us without consent of a parent or legal guardian, please contact us using the details at the bottom of this Policy so that we can delete that information.
4. HOW DO WE COLLECT YOUR PERSONAL INFORMATION?
4.1. We collect your personal information directly from you when you:
1. sign up to an account with Race Ultra;
2. visit our website or use the application;
3. sign up to mailing list to receive our tips, offers and marketing emails;
4. sign up for or attend a Race Ultra event;
5. interact with us online in any way;
6. contact us via phone, email, letter, social media or any other forum;
7. make a purchase for goods or services via our website or application;
8. apply for a position with us as an employee, contractor or volunteer;
4.2. Collecting personal information from third parties
We may also collect your personal information from third parties or through publicly available sources, for example from the Google Play Store and iOs App Store. We collect your personal information from these third parties so that we can assign subscriptions and payments to your account. We take steps to ensure that any data we collect from third parties is shared with us with your permission.
5. HOW DO WE USE YOUR PERSONAL INFORMATION?
5.1. We use personal information for many purposes in connection with our functions and activities, including the following purposes:
1. provide you with information or services that you request from us;
2. deliver to you a more personalised experience and service offering;
3. improve the quality of the services we offer;
4. internal administrative purposes;
5. marketing and research purposes;
6. to be able to contact you in the case of any queries; and
7. for fraud prevention purposes.
6. DISCLOSURE AND SHARING OF PERSONAL INFORMATION

We may disclose your personal information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose your information. For example, we may disclose your personal information to:
1. our third party service providers (for example, our IT providers);
2. our marketing providers;
3. our employees, volunteers, contractors or service providers where necessary to provide goods and services to you;
4. our business advisors including accountants, lawyers and other professional services where reasonably required for them to fulfill their obligations to us or to advise us; and
5. if required by law to any person or body authorised by such law. Your Personal Information may be disclosed to third parties if disclosure is required by law. If we sell our business, or we have a change in control, your Personal Information will be disclosed and transferred to the new owner/controller for that purpose. We are not liable for any loss, damage or claim arising out of a third party’s use of your Personal Information where we were authorised by you or by law to provide that third party with your Personal Information.
6.2. Disclosure of personal information overseas
Race Ultra is based in Australia and may be required to disclose your information to our third party service providers that may have an international infrastructure. Personal information may be share overseas in order for our third-party service providers to assist us with our business. For example some of our software provided have been based overseas.
Our main data storage systems is based in Cairns, Australia and accordingly we will only ever disclose personal information outside Australia where we are permitted to do so under the applicable laws. We have taken the necessary steps to keep all personal information safe and protected against misuse, interference, loss or unauthorised use.
7. HOW DO WE PROTECT YOUR PERSONAL INFORMATION?
7.1. Race Ultra will take reasonable steps to ensure that the personal information that we hold about you is kept confidential and protected against misuse, interference, or loss, and from unauthorised access, modification and disclosure, including but not limited to:
1. having a robust physical security of our premises and databases / records;
2. having technological measures in place (for example, anti-virus software, fire walls);
3. taking measures to restrict access to only personnel who need that personal information to effectively provide services to you; and
4. other systems required in accordance with relevant government regulation and requirements.
7.2. While we take all reasonable precautions to protect your personal information, we exclude all liability for the consequences of any unauthorised access, use or disclosure of Personal Information to the maximum extent permitted by law.
8. ONLINE ACTIVITY
8.1. Cookies
The Race Ultra website uses cookies. A cookie is a small file of letters and numbers the website puts on your device if you allow it. These cookies recognise when your device has visited our website(s) before, so we can distinguish you from other users of the website. This improves your experience and the Race Ultra website(s).
We do not use cookies to identify you, just to improve your experience on our website(s). If you do not wish to use the cookies, you can amend the settings on your internet browser so it will not automatically download cookies. However, if you remove or block cookies on your computer, please be aware that your browsing experience and our website’s functionality may be affected.
8.2. Website analytics
Our website uses Google Analytics 4 to help us better understand visitor traffic, so we can improve our services. Although this data is mostly anonymous, it is possible that under certain circumstances, we may connect it to you.
8.3. Direct marketing
We may send you direct marketing communications and information about our services, opportunities, or events that we consider may be of interest to you if you have requested or consented to receive such communications.
These communications may be sent in various forms, including mail, SMS, fax and email, in accordance with applicable marketing laws, such as the Australian Spam Act 2003 (Cth).
You consent to us sending you those direct marketing communications by any of those methods. If you indicate a preference for a method of communication, we will endeavour to use that method whenever practical to do so.
You may opt-out of receiving marketing communications from us at any time by following the instructions to “unsubscribe'' set out in the relevant communication / contacting us using the details set out in the “How to contact us” section below.
In addition, we may also use your personal information or disclose your personal information to third parties for the purposes of advertising, including online behavioural advertising, website personalisation, and to provide targeted or retargeted advertising content to you (including through third party websites).
8.4. Retention of personal information
We will not keep your personal information for longer than we need to. In most cases, this means that we will only retain your personal information for the duration of your relationship with us unless we are required to retain your personal information to comply with applicable laws, for example record-keeping obligations.
When we no longer need to store your data for these reasons, under the APPs we will take reasonable steps to destroy or permanently de-identify the information.
9. HOW TO ACCESS AND CORRECT YOUR PERSONAL INFORMATION
Race Ultra will endeavour to keep your personal information accurate, complete and up to date. We will handle requested for access to your personal information in accordance with the APPs.
Subject to the provisions of the Privacy Act 1988 (Cth), you may access any of your personal information at any time. If you wish to make a request to access and / or correct the personal information we hold about you, you should make a request by contacting us and we will usually respond within 7 days. We will deal with such a request by following the procedure outlined below:

10. LINK TO THIRD PARTY SITES
Race Ultra website(s) may contain links to websites operated by third parties. If you access a third party website through our website(s), personal information may be collected by that third party website. We make no representations or warranties in relation to the privacy practices of any third party provider or website and we are not responsible for the privacy policies or the content of any third party provider or website. Third party providers / website are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.
11. INQUIRIES AND COMPLAINTS
For complaints about how Race Ultra handles, processes or manages your personal information, please contact quinn@raceultra.com. Note we may require proof of your identity and full details of your request before we can process your complaint. Please allow up to 7 days for Race Ultra to respond to your complaint. It will not always be possible to resolve a complaint to everyone’s satisfaction. If you are not satisfied with Race Ultra’s response to a complaint, you have the right to contact the Office of Australia Information Commissioner (at www.oaic.gov.au/) to lodge a complaint.
12. CHANGES TO THIS POLICY
From time to time it may be necessary for Race Ultra to review and revise this privacy policy. We will notify you before we make material changes to this policy and give you an opportunity to review the revised policy before deciding if you would like to continue to use the Services.
